On Thursday, the Office of Information and Regulatory Affairs (OIRA), the White House office that reviews rules, received a final Labor Department rule. The rule would set up a fiduciary safe harbor covering crypto, real estate and private equity as choices in 401(k) plans. A safe harbor is a legal protection for plan managers who meet certain conditions.

The arrival at OIRA puts public release of the rule within reach.

In a separate step, the White House has started to review a proposal from the SEC on financial requirements for broker-dealers that deal in crypto. OIRA files it under the identifier 3235-AN48. The agency's own regulatory agenda lists Rules 15c3-1 and 15c3-3, which cover how much capital brokers must hold and how customer assets are protected.
